1. Who we are

SMMNEAR is a sole-trader business operated by MINHAJ MUNTASIR. It is not a limited company and has no company registration number. All references to "we" or "us" mean SMMNEAR.

2. Services

We provide social media advertising services, which may include campaign management, ad creative production, audience targeting and tracking setup, social media management and performance reporting. The exact scope for each client is confirmed in writing before work begins.

3. Fees and payment

Fees are agreed in advance and invoiced as set out in your quotation. Advertising spend paid to platforms is separate from our fees and is your responsibility unless agreed otherwise. Late payment may result in work being paused.

4. Client responsibilities

• Providing timely access to accounts, assets and approvals
• Ensuring supplied materials do not infringe third-party rights
• Ensuring the products or services advertised are lawful

5. Results

Advertising performance depends on factors outside our control, including platform policies, auction competition and market demand. We work to agreed objectives but cannot guarantee specific results, revenue or placement.

6. Intellectual property

You retain ownership of your brand assets. On full payment, you receive a licence to use the ad creative produced for your campaigns. We may reference completed work as a portfolio example unless you ask us not to.

7. Confidentiality

Each party will keep the other's non-public information confidential and use it only for delivering the services.

8. Term and cancellation

Work runs on a rolling monthly basis unless stated otherwise. Either party may end the arrangement with reasonable written notice. Cancellation is covered further in our Refund & Cancellation Policy.

9. Liability

To the extent permitted by law, our total liability is limited to the fees you paid us in the three months before the claim. We are not liable for indirect or consequential losses, including lost profits or lost advertising spend caused by platform decisions.

10. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

11. Changes

We may update these terms from time to time. The version published on this page applies to current work.
